These Terms and Conditions ("Terms", "Terms and Conditions") govern your access to and use of this website (the "Service") operated by company legal name ("us", "we", or "our").

BY COMPLETING AND SUBMITTING A REQUEST TO CONNECT WITH A PARTNER THROUGH THE CONVERTBATHROOM.COM SITE (THE "SITE"), YOU AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT AS WELL AS THE PRIVACY POLICY POSTED ON THIS SITE, WHICH IS INCORPORATED HEREIN BY REFERENCE. AS SUCH, YOU MUST READ THIS AGREEMENT AND THE PRIVACY POLICY BEFORE SUBMITTING YOUR REQUEST. IF YOU DO NOT AGREE WITH THESE TERMS AND THE PRIVACY POLICY, YOU ARE NOT AUTHORIZED TO ACCESS OR USE OUR SERVICE.

The terms and conditions outlined in this Terms of Service Agreement ("Agreement") govern your use of the ConvertBathroom.com Service ("Service"), available through the Site. You should carefully review this Agreement prior to downloading, accessing, or using any portion of the Service. The Service is provided to you only on the condition that you accept and agree to all the terms and conditions set forth in this Agreement. This Agreement becomes effective when you submit your Service Request Form ("Request Form" or "Form") to connect with one or more partners in our marketplace ("Marketplace Participants") and/or when you begin accessing or using the Service, whichever occurs first.

References to "we" herein mean company, including successors and assigns, which operates the Site and the Service. References to "Individual" or "you" refer to any user of this Site and Service.

1. Eligibility Requirements.

You must be at least 18 years of age (or the age of majority in your state of residence) to create an Account. If you provide any false, inaccurate, misleading, or incomplete information in your Request Form, we may immediately suspend or terminate your access to and use of the Service. You are responsible for maintaining the confidentiality of any usernames and passwords associated with your Request Form.

2. Service Request Process.

The Service is designed to connect Individuals who submit a Request with one or more Marketplace Participants. To utilize the Service, you must complete and submit the information requested in the Request Form, which may include (without limitation) your name, street address, phone number, date of birthand any other information requested during the collection process.

Alimony, child support, or separate maintenance need not be disclosed unless used for credit purposes. You represent and warrant that all information provided in your Request Form is accurate and truthful. Failure to do so may result in denial, suspension, or termination of Service. We reserve the right, at our sole discretion, to refuse to provide the Service with or without cause.

Credit Authorization.By submitting your Service Request, you provide written authorization under the Fair Credit Reporting Act to company and its Marketplace Participants, agreeing that (a) you are submitting an inquiry regarding products offered by Marketplace Participants, (b) we may share some or all of your Request Form information with Marketplace Participants in accordance with our Privacy Policy, and (c) your consent allows Marketplace Participants to review, verify, and evaluate your information in real-time or otherwise to determine your eligibility for services and taking any other actions necessary to assess your potential qualification for credit.

Consent to Communications. By providing your contact information and submitting a Service Request, you expressly consent to receive communications from us and our Marketplace Participants under the Telephone Consumer Protection Act ("TCPA"). This means you agree that we and the Marketplace Participants may contact you at the phone number (including any mobile number) and email address you provided, to discuss or offer the products and services you inquired about. You consent to receive these communications via telephone calls or text/SMS messages, which may be made using an automatic telephone dialing system or artificial/pre-recorded voice messages. You understand that your telephone company may charge you standard message or data fees for such communications.

Your consent to receive telemarketing calls or texts is not a condition of purchasing any goods or services.We will not send you marketing communications unrelated to your Service Request without your consent. You can opt out of marketing calls or texts at any time by notifying us or the applicable Marketplace Participant (for example, by using an opt-out method provided in the call or message).

CONSENT FOR ELECTRONIC SIGNATURES, RECORDS, AND DISCLOSURES ("E-CONSENT")

Please read this information carefully and retain a copy for future reference.

Introduction
You are submitting a request to connect with a Marketplace Participant. To offer you services, Marketplace Participants require your consent to utilize electronic signatures, records, and disclosures ("E-Consent"). By clicking the link to accept our terms, you acknowledge receipt of this E-Consent and consent to conduct transactions using electronic signatures, disclosures, records, and contractual documents ("Disclosures").

Scope of Consent

This E-Consent applies to all online interactions with Marketplace Participants, including on mobile devices. By agreeing to this E-Consent, Marketplace Participants may process information and interact with you electronically for all online interactions and may send electronic notices related to transactions. Disclosures may be provided on our Site, the Marketplace Participant’s website, or by e-mail.

Consenting to Do Business Electronically

You should evaluate whether you have the hardware and software necessary to conduct transactions electronically.

Hardware and Software Requirements

To access and retain Disclosures electronically, you must have a computer or device capable of accessing the Internet, an email account, and a browser that supports at least 128-bit encryption (e.g., Internet Explorer, Mozilla Firefox). You may need a PDF reader to view certain documents and a printer or storage device to retain copies. Questions regarding requirements should be directed to the Marketplace Participants.

Withdrawing Consent

Your E-Consent for the connection service is a one-time consent and cannot be withdrawn. You may withdraw E-Consent for future interactions with Marketplace Participants at any time without charge. Withdrawing consent prior to credit consideration may prevent eligibility. The validity of prior electronic Disclosures is not affected.

Change to Contact Information

Update your electronic or mailing address with Marketplace Participants by logging in to their website or sending a written update.

YOUR ABILITY TO ACCESS DISCLOSURES. BY CLICKING THE LINK, YOU CONFIRM THAT YOU CAN ACCESS DISCLOSURES IN THE FORMATS DESCRIBED ABOVE.

CONSENT. BY CLICKING THE LINK, YOU ACKNOWLEDGE THAT YOU HAVE READ AND CONSENT TO USING ELECTRONIC SIGNATURES, RECORDS, AND DISCLOSURES.REFUSAL TO CONSENT PREVENTS ELECTRONIC TRANSACTIONS AND SERVICE DELIVERY BY MARKETPLACE PARTICIPANTS.

Under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and applicable state laws, your consent permits electronic delivery of required information and use of electronic signatures. Refusal to consent will prevent transaction completion.

3. Information Review Process

Marketplace Participants may review your Request Form information to determine qualification. If approved, we provide contact information or redirect your browser. After connection, we have no involvement in approval or Service Request processing. Subsequent interactions are governed by the Marketplace Participants’ policies.

You authorize Marketplace Participants to share financial transaction history among affiliates, contractors, and partners to evaluate credit. We are not responsible for delays or failures caused by inaccurate information or technical issues. We are not agents of you or Marketplace Participants and do not recommend specific products. Marketplace Participants may retain your information for marketing or business purposes.

We take privacy and data protection seriously. Your personal information will be collected, used, stored, and shared as described in our Privacy Policy. We comply with applicable federal and state privacy laws, including the Gramm-Leach-Bliley Act ("GLBA") and state consumer privacy laws such as the California Consumer Privacy Act ("CCPA") (as amended by the California Privacy Rights Act ("CPRA") and Nevada privacy laws.

By using the Service, you consent to our data practices as detailed in the Privacy Policy, and you have certain rights regarding your information as described therein (for example, the right to opt out of the sale of personal data, or to request access or deletion of your data). Please review our Privacy Policy for more information on how we protect your personal information and how you can exercise your rights.

4. License

You are granted a personal, revocable, non-exclusive, royalty-free, non-transferable license to access the Site, conditioned on compliance with this Agreement. You may not modify, copy, distribute, decompile, frame, reverse engineer, exploit, or otherwise misuse the Site or its content. Automated access, unauthorized account access, interference with the Site, identity manipulation, harvesting information, or unlawful use is prohibited. Copying or reproducing any Services, content, or materials for redistribution is expressly forbidden.

5. Disclaimer Of Warranties, Release, And Limitation Of Liability

THE SERVICE, SITE, AND ALL INFORMATION, SOFTWARE, AND MATERIALS PROVIDED THEREIN (COLLECTIVELY, "SERVICE INFORMATION") ARE PROVIDED "AS-IS" AND "AS AVAILABLE" AND MAY CONTAIN ERRORS OR INACCURACIES. WE MAY MODIFY THE SERVICE INFORMATION AT ANY TIME. YOU ASSUME ALL RISKS RELATING TO USE OF AND RELIANCE ON SERVICE INFORMATION. WE AND OUR AFFILIATES, MARKETPLACE PARTICIPANTS, AND SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. YOU RELEASE US FROM LIABILITY FOR DAMAGES ARISING FROM FORCE MAJEURE OR EVENTS BEYOND OUR CONTROL. TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM OR RELATED TO THE SERVICE OR YOUR USE OF THE SITE. YOU AGREE TO INDEMNIFY US FOR VIOLATIONS OF LAW RELATING TO CONTRACTS OR INTERACTIONS WITH MARKETPLACE PARTICIPANTS.

6. Termination

We may suspend or terminate Service or this Agreement immediately for breach, legal requirement, suspected fraud, termination of Marketplace partnerships, commercial non-viability, or discontinuation of Service in your jurisdiction. Termination is effective without notice.

7. Governing Law; Dispute Resolution

All disputes, claims, or controversies, including non-contractual claims, shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its rules then in effect when the Notice of Arbitration is filed. This agreement to arbitrate is governed by the Federal Arbitration Act ("FAA").YOU WAIVE YOUR RIGHT TO GO TO COURT AND TO PARTICIPATE IN CLASS ACTIONS.

Rights are determined by a neutral arbitrator. This arbitration agreement will not apply to an individual claim that you or we bring in small claims court, so long as the claim remains in that court on an individual, non-class basis. You may opt out by sending a written notice to our mailing address listed on the Site, within 30 days of acceptance, including the subject line: "Arbitration Opt Out," your full name, and email address used to consent.

8. Miscellaneous

This Agreement, together with the Privacy Policy, constitutes the entire agreement. No waiver of any breach constitutes a waiver of future breaches. Section headings are for reference. Invalid provisions do not affect enforceability of others. You may not assign your obligations; we may assign our rights.
